Defective products cause workplace injuries in construction

Although you already know working in the construction industry is dangerous, you may expect the risks to come from certain sources. For example, falls from heights, strikes from objects and electrocution are common hazards, says OSHA, and construction workers have a high fatality rate.

However, another common source of accident and injury on the job is defective products. The very equipment you use, including for safety, can cause you harm. If this happens to you, you may be able to hold multiple parties liable.


With rates of falling so great in construction, it is no surprise that faulty scaffolding is one reason for the high numbers. The danger is severe, often leading to traumatic brain injuries, broken bones, paralysis and even death in some cases. Scaffolding production and use must meet strict guidelines to ensure safety.

Heavy machinery

Do you drive a bulldozer, backhoe loader, tractor or other vehicle? Do you operate other types of heavy machinery? You rely on them having no errors in design, production or marketing, because of the precision they require. If a part malfunctions, the results are usually catastrophic due to the size and nature of the equipment. For example, the machinery can tip over and trap you underneath it, or the brakes may fail. Another possibility is your employer has not properly maintained the equipment.

Power tools

Power tools may be smaller in size, but they are just as hazardous as large machinery. Nail guns can misfire, motors can overheat and safety guards may not provide adequate protection. Despite your own proper training and experience, a poor design, misstep in manufacturing or insufficient warning can create a problem when you use the tool. Injuries that may occur are burns, electric shock or amputation. Such injuries can prevent you from being able to return to work, thus causing you to lose your ability to provide for your family.
